Client Responsibilities

  • Use our services lawfully and ethically.

  • Keep your account information current.

Payments

Payment is due according to the terms outlined in your proposal, invoice, or subscription agreement.

Recurring subscriptions are billed automatically every 30 days unless otherwise stated.

By purchasing a subscription, you authorize Agency Brand Aware to charge your selected payment method for all recurring fees until your subscription is canceled.

Failure to maintain a valid payment method may result in suspension or termination of services.

 

Free Trials

Certain software products or subscription services may include a 7-day free trial.

The purpose of the trial is to allow you to fully evaluate the platform before becoming a paying subscriber.

If you choose not to continue after the trial period, you must cancel before the trial expires to avoid recurring charges.

Once a paid subscription begins, it becomes subject to the cancellation terms outlined below.

 

Refund Policy

Because Agency Brand Aware provides digital products, consulting services, marketing services, software access, and customized solutions, all sales are generally final.

We do not offer refunds for:

  • Digital products

  • Downloadable resources

  • Consulting services

  • Marketing services already performed

  • Subscription fees already billed

  • Completed design or creative work

Boutique AI Services

Certain Boutique AI Services include an initial setup fee.

If you request cancellation within the first 30 days of service, you may be eligible for a refund of your subscription payment less the applicable setup fee.

If your setup fee was waived as part of a promotional offer, the standard setup fee will be deducted from any eligible refund.

Costs incurred for third-party communication services—including text messaging, email delivery, phone usage, and similar usage-based charges—are non-refundable and remain the responsibility of the client.

 

Subscription Cancellations

Subscriptions renew automatically every 30 days.

To avoid future billing, cancellation requests must be submitted at least 30 days before your next renewal date.

If notice is received less than 30 days before renewal:

  • Your subscription will be canceled.

  • No additional renewals will occur after the current billing period.

  • Payments already processed are not refundable.

You may continue using your subscribed services through the end of your paid billing period unless otherwise stated.

 

Results Disclaimer

Agency Brand Aware is committed to delivering professional strategies, innovative marketing solutions, and measurable business improvements.

However, because every business, industry, market, and customer base is different, we cannot guarantee:

  • Revenue increases

  • Sales results

  • Search engine rankings

  • Advertising performance

  • Social media growth

  • Lead volume

  • Customer acquisition

  • Business success

Your success depends on many factors outside our control, including market conditions, competition, pricing, operational execution, and your participation throughout the engagement.

 

Intellectual Property

Unless otherwise agreed in writing:

  • Agency Brand Aware retains ownership of its proprietary methodologies, processes, software, templates, educational materials, and internal systems.

  • Clients retain ownership of materials they provide to Agency Brand Aware.

  • Upon full payment, clients receive the rights outlined in their service agreement for completed deliverables.

No part of our proprietary materials may be copied, resold, redistributed, or reproduced without our written permission.

 

Acceptable Use

You agree not to:

  • Use our services for unlawful purposes.

  • Attempt to interfere with the operation or security of our systems.

  • Upload malicious software or harmful code.

  • Infringe upon the intellectual property rights of others.

  • Misrepresent your identity or business.

Agency Brand Aware reserves the right to suspend or terminate services for violations of these Terms.

 

Third-Party Services

Some services may integrate with trusted third-party platforms or providers to deliver functionality such as payments, communications, scheduling, analytics, or marketing tools.

Agency Brand Aware is not responsible for interruptions, outages, or changes caused by third-party providers beyond our reasonable control.

 

Limitation of Liability

To the fullest extent permitted by law, Agency Brand Aware shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our website, software, products, or services.

Our total liability for any claim shall not exceed the amount paid by the client for the specific service giving rise to the claim during the twelve (12) months preceding the event.

Indemnification

You agree to defend, indemnify, and hold harmless Agency Brand Aware, its owners, employees, contractors, and partners from claims, damages, liabilities, costs, and expenses arising from:

  • Your use of our services.

  • Your violation of these Terms.

  • Your infringement of another party's rights.

  • Information or materials you provide to us.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the state in which Agency Brand Aware is organized, without regard to conflict of law principles.
